The followings terms and conditions of service (these "TSCs") govern your access including any content, functionality and services offered on or through the following sites or mobile applications ("Sites") of Pacheco Barroso Ltd. and its subsidiaries (hereinafter PB) as applicable:

 

A PB and its subsidiaries are collectively referred to as "PB", "we" and "you", “customer”, or “user” means you as a user of the Site.

 

Please read the Terms and Conditions of Service carefully before you start using the Site. By using the Site, opening an account, or clicking to accept or agree to the Terms and Conditions of Service when this option is made available to you, you accept and agree, on your behalf or on behalf of your employer or any other entity (if applicable), to be bound by and abide by these Terms and Conditions of Service. You also acknowledge that you have read and understand our Privacy Policy. If you do not agree to these Terms and Conditions of Service or the Privacy Policy, you should not access or use the websites of PB. For more detailed policies regarding Site activity and use, please read the designated articles here.

 

This Website is available only to those over 18 years of age, with the exception of those under 18 who have permission and supervision from their parents or legal guardians. Use of PB platforms by those under 18 requires the explicit consent of their legal guardians. PB does not intentionally collect personal data from minors without such authorization. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

The original language of these Terms and Conditions of Service is Portuguese. PB provides translations for convenience only. In the event of a conflict between the original Portuguese version and any translation, the Portuguese version shall prevail.

Applicable Law and Jurisdiction -These Terms are governed by the laws of the Republic of Angola. Any disputes arising from the interpretation or execution of these Terms are subject to the jurisdiction of the district of Luanda, with the express waiver of any other jurisdiction. Any dispute arising from these Terms may, where possible, be resolved through out-of-court alternative dispute resolution (ADR) mechanisms before being submitted to the competent court.


 

How it works

Overview (key terms in a nutshell)

Only users residing in countries where the services are offered and providers approved by the relevant team of PB can join to disclose, buy and lists and/or products (tangible and intangible) on the platforms of PB. Navigation on our platform can be freely marketed - PB has every right to change the mode of use in line with its strategy. When using our platforms and/or when requesting a product to or service you agree to provide us with accurate, complete and up-to-date information and shall not do so for fraudulent or misleading purposes.

 

You are solely responsible for any activity on your behalf and for maintaining the confidentiality and security of your financial data. We are not responsible for any acts or omissions on your part in relation to its use.

 

PB's websites have several objectives (e.g., serving as tools for exchange between suppliers and end consumers, such as discovering new works of art, providing business management tools, and more). The quality and guarantee of services are the sole responsibility of partner suppliers.
 

The Role of PB
(Provider of commercial intermediation and arrangement services)

 

Pacheco Barroso Ltd. (hereinafter “PB”) acts, through its digital platforms, as provider of technological intermediation and commercial provision services, providing an online ecosystem that allows the promotion, management and marketing of goods and services by user-suppliers (traders, service providers, freelancers, artists, content producers and other partners) to user-buyers.

A PB is not the owner of the listed products or serviceson their platforms,does not interfere with its definition or provision, nor does it assume any responsibility for its legality, quality, safety, suitability or delivery. Unless expressly stated otherwise,PB is not a party to transactions concluded between user-suppliers and user-buyers. Its role is limited to providing technological and operational tools that facilitate interaction between the parties involved.

Em particular, a PB:

  1. Provides access to proprietary digital platforms, including websites, online stores, marketplaces and point of sale (POS) systems, upon express acceptance of these Terms and Conditions;

  2. Allows the listing, promotion and sale of products and/or servicesby user-suppliers, autonomously, within the technical, legal and editorial limits defined by PB;

  3. Integrates complementary tools, such as certified billing systems (e.g. xZero), payment methods, performance reports, and logistics services from independent partners, where applicable;

  4. Can carry out communication and dissemination campaigns of products, services or brands of participating suppliers, under internally defined criteria and without the obligation of continuous promotion;

  5. Provides initial training and technical support, when necessary, to ensure the correct use of the available platforms and tools.

The user-supplier isfully responsible for its activity, including: (i) the veracity and updating of the information listed; (ii) the legal compliance of its activity and its products/services; (iii) compliance with tax, health and consumer protection regulations; and (iv) customer service, communication and complaint resolution.

The user-supplier undertakes to:

  • Ensure that the information, products and services presented are true, up-to-date and legal;

  • Fully comply with all legal and tax regulations applicable to your activity;

  • Respond to customer complaints diligently and in good faith;

  • Communicate to PB any relevant changes (e.g. closure, new address, license updates).

The relationship between PB and the user-supplier is non-exclusive, not subordinate and without any employment, corporate or commercial representation relationship. Adherence to PB platforms does not grant the user-supplier the right to present himself as a representative or agent of PB, unless prior, express and written authorization is given.

PB reserves the right to:

  • Refuse, suspend or remove any user's access to its platforms, in case of violation of these Terms, legal norms or internal ethical standards;

  • Change, update or discontinue, in whole or in part, functionalities of its platforms, with reasonable prior notice;

  • Request additional documents or data at any time to verify the identity, licensing or commercial legitimacy of the user-supplier.

By using the PB platforms, the user-supplier acknowledges and accepts that PB acts exclusively as a technological and operational intermediary, being exempt from liability for any damages, losses or disputes arising from the relationship between the transacting parties, except in cases where such liability is provided for by mandatory legal norm.

PB acts exclusively as a provider of technology intermediation services and assumes no responsibility for contractual, legal, tax, or operational obligations between users, business partners, or third-party providers. The relationship between users and providers listed on PB platforms is entirely independent of PB.

 

Services - Purchase of Physical and/or Digital Products and Services (Digital Stores and Marketplaces)
(Offered through various brands and partners)

 

How a user-buyer can request and purchase products or services -Buyers navigate the platform, identify one or more desired products or services, read the details, and follow the necessary steps to purchase (in some instances, a meeting with our technical team may be necessary to better clarify the buyer's requirements). They will be required to provide personal data such as, but not limited to, first name, last name, date of birth, ID number, mobile phone number, email address, and potentially others.

 

How to pay -Generally, for simple products or services, payment is made when the order is placed by the user-buyer, and an invoice-receipt is issued when the customer confirms receipt of the product or service. For more complex products or services, payment may be made after a final meeting with our technical team, where all details of the services requested by the user-buyer are confirmed. A proforma invoice will be issued to the user-buyer with payment details along with the contractual details relevant to the desired services. The complexity of a product or service is determined solely by PB or, in some instances, the responsible merchant. In Angola, we may decide which payment methods are accepted on our platforms:

  • Multicaixa Reference paid via a Multicaixa (ATM), your bank's Online Banking app or Multicaixa-express

  • When available - Bank transfer from your bank's Online Banking application, from a bank branch or Multicaixa-express

 

Deliveries -Delivery of products purchased through the PB ecosystem that require this feature will be made through logistics partners. Delivery costs will be stipulated in the customer's quote and invoice. Logistics partners are fully responsible for the delivery status. For deliveries, location details will be required (e.g., but not limited to, location description or coordinates provided manually or acquired automatically), which will be shared with our partners as necessary.

 

Complaints and non-receipt of products or services -All complaints must be communicated to the merchant providing the product or service. If you do not receive an acceptable resolution, you can contact our management team via:geral@pachecobarroso.comwith the subject line: “[Invoice Number] Complaints” and all the details in the body of the email. It is the customer's sole responsibility to initiate this complaint process.

 

Customer cancellations -Most purchases go through five stages: Pending -> In Preparation -> Ready -> On the Way -> Delivered. In some instances, customers may need to cancel. This process must be requested before moving on to the In Preparation stage. If the request is made after the In Preparation stage has begun, the returns and exchanges process continues if possible—perishable or opened products generally cannot be returned.

 

Returns and exchanges -The return policy is managed by the service or product provider. Generally, perishable, adulterated, consumable, and non-original packaging (including envelopes) products cannot be returned. Returns must generally be requested before final delivery of the product. The cost of returns for exchanges of correctly delivered products or services will be the responsibility of the user/buyer. The cost of returns for exchanges of erroneously delivered products or services will be the responsibility of the supplier. Returns for refunds will be analyzed on a case-by-case basis but are only applicable to deliveries not made and before an invoice is issued.

 

Refunds -We do not issue refunds once payment is made unless: the final product does not pass the PB quality management team's review after completion, or the delivery of the product or service is not made and the customer requests a return, or acts of God, death/illness of members of the development team, and unavailability of resources to develop the product (e.g., but not limited to, lack of internet connection by service providers nationwide).

 

Cancellations from providers or PB– In some cases, we may have to cancel. Our team will do its best to provide the customer with an acceptable alternative. If no alternative is found, a 100% refund will be issued.

 

Delays and finish in line with specifications- For projects managed directly by PB, PB is committed to delivering projects within the stipulated deadline and with the content agreed upon with its clients. There will be data/information (e.g., but not limited to, legal texts, photos, and videos) that must be delivered to the project team by the client in specific formats and deadlines. Failure to deliver this required information in a timely manner may lead to delays or final products without the full content requested by the client. Projects are divided into interdependent phases (pre-communicated to clients before signing the contract). Moving from one phase to another depends on the client's approval, confirming its completion, and once completed, there is no turning back.

 

Testing period- Products and services generally don't have a trial period because, for each order, the buyer and the provider are in contact to align on the final result. For some solutions (e.g., Front-End Development), after the digital solution is completed, the client has five business days to use the provided solution and report any operating errors for our team to correct. During this period, the solution's functional logic is not evaluated, as it was provided by the client. After this period, any necessary changes will be outside the scope of the project and will be charged as an additional service.

 

Legal liability- Members/user-providers and customers/user-buyers cannot hold PB or any member of the company liable for problems or financial losses resulting from the use of the digital solutions provided after the trial period ends. Members and customers are responsible for providing the necessary legal texts for the digital solutions when necessary (e.g., but not limited to, the Terms and Conditions and Privacy Policy for websites).

Services - Art Gallery
(Offered through the AlexPabo brand)

 

How can the user request a service?- Users browse the platform, identify a desired artwork, read the details, and follow the necessary steps to complete the desired transaction. (You will need to provide some personal data such as, but not limited to, first name, last name, date of birth, ID number, mobile phone number, email address, and potentially others.) By placing a private order, customers understand that this order is made to PB and that PB is the entity that owns the Intellectual Property arising from this private work.

  • For works domiciled with PB(e.g., AxP Collection)

    • These works are in possession of PB and ready for delivery in Luanda within 7 working days.

    • Once a customer finds a piece they like, they can visit our online store to purchase and pay for it and confirm whether they want to pick it up or have it delivered. Buyers receive an invoice or receipt when the piece is picked up or delivered.

  • For works NOT domiciled with PB(e.g., Independent Collection)

    • These works are not in the possession of PB, they are in the possession of the artists and the delivery time may vary inside and outside Luanda.

    • Once a customer finds a piece they like, they begin the purchasing process: first, a message will be sent to the artist to confirm whether the work is available and the price. Second, upon confirmation from the artist, the customer purchases and pays for the work and confirms whether they want to pick it up at PB's office or have it delivered. Buyers receive an invoice/receipt upon pickup/delivery.

  • For commissioned works(private works)

    • These works are custom-made by PB's artistic partners using the highest-quality materials. Delivery times are specified in the product description, but typically take two weeks within Luanda.

    • The client accesses our commissioning portal and begins the purchasing process: first, they choose the type of work they want from the available options; second, they purchase and pay for the work and confirm whether they want to pick it up at the PB office or have it delivered to them; third, we contact our network of artistic partners to execute the work; and fourth, a message is sent to the client confirming when the work has begun, is completed, and is on its way for delivery or is ready for pickup. Buyers receive an invoice/receipt when the work is picked up/delivered.

    • If a change request is accepted, there will be additional charges of at least 15% of the price paid for the commissioned work to account for items such as, but not limited to: any additional time required, any new materials required, administrative costs, and the impact on the delivery of other artwork. Change requests may also impact the artwork's delivery time, and the user will be informed of the new time when the proforma invoice is sent.

 

How to pay- Read relevant section above.

 

How to receive your artwork– If you are receiving the work in Luanda, Angola, we can arrange home delivery with our partner supplier. We will do our best to deliver within 7 business days for works in the PB collection. Alex Pabo will return your order to his offices if you spend more than 15 minutes searching for the delivery location or if the customer is unreachable. We are not responsible for any damage to the order. Alternatively, the buyer can pick up the work from our offices within 2 business days after the work is completed. After this period, we are not responsible for any damage to the order. If the work is in another province or another country, the buyer is responsible for transporting the work, who will arrange collection with our team.

 

Complaints and non-receipt of service- Any complaints must be reported by the end of the day (11:59 p.m.) upon receipt of the artwork via email to geral@pachecobarroso.com with the subject line "[Invoice Number] Complaints" and all details in the body of the email. We will do our best to help. The customer should know that the partner supplier is solely responsible for the artwork they provide, not PB and its subsidiaries. Partner suppliers with repeated complaints or serious issues may be banned from the platform. However, it is the customer's sole responsibility to initiate this complaint process.

 

Returns- To prevent potential counterfeiting, we only accept returns of artworks in our custody. This means that the artwork is either delivered in Luanda by our team or collected from our offices by the client. Return requests must be made upon delivery and before the client signs the confirmation of receipt. A 10% deposit of the purchase price will be retained to cover administrative costs (e.g., shipping). For commissioned works, there are no refunds once payment is made, as materials are purchased and work begins immediately, unless: the artwork is visibly damaged upon delivery (if NOT to the client's specifications) and the client does not agree to keep it as is; the artwork fails to pass Alex Pabo's team's review after completion; or the artwork is delivered after the stipulated deadline for reasons other than acts of God, death/illness of the artist, and unavailability of materials for delivery of the commissioned work.

 

Customer cancellations- In some cases, customers may need to cancel. This process must be requested before the preparation process begins. If the request is made after the preparation process has begun, the returns and exchanges process follows.

Supplier cancellations– In some cases, partner suppliers may have to cancel. The Alex Pabo platform will do its best to provide the customer with an acceptable alternative. If no alternative is found, a 100% refund will be issued.

 

Legal liability- Users and supplier partners cannot hold PB or any member of the company responsible for problems with the works provided by suppliers or for financial losses resulting from the provision of defective works by suppliers.

 

Services - Classic Websites and Digital Stores
(Offered through the brands FortCode, xZero, Kytutes, Alex Pabo and others)

 

Websites, online stores, local stores (POS) and other services for companies, freelancers, and merchants in general (hereinafter members)

 

How to join the Classic Website -Companies, freelancers, and merchants in general can request a free Classic Website membership. PB is free to accept or reject, without explanation, anyone who may or may not join and remain a member of any service or product offered by PB. Classic websites have standard templates (we currently have three templates: Portfolio, Service, and Product). The Classic Website is created as a subdomain of one of PB's domains and made available for use by the member entity. Only the member's parent or legal representative can request the creation of a Classic Website.

 

What's included- The Classic Website is exclusively informative - members can place information in the places standardized by PB (e.g., but not limited to: address, name, brand, logo, etc.).

 

Premium elements- There are premium elements that can be activated within or linked to Classic Websites. By activating or linking these elements, the member agrees to pay the invoice that will be charged by PB. The premium elements and their details will be made available in the Premium Elements online store, which members can access via the Classic Website control panel or other means to be determined by PB. We strongly recommend that only the company's manager or legal representative have access to the Classic Website control panel, and it is assumed that all orders placed through the control panel reflect a legal agreement that the company must honor and pay for. Premium elements generally operate on a prepayment system, with the premium element deactivated at the end of the period if the renewal payment has not been made by the company before the end of the period. PB or other entities are not responsible for material or immaterial damages that may be caused by the interruption of the member's business or activities due to the deactivation of premium elements.

 

Simple online store -They allow freelancers and businesses to list their products or services in an online digital environment, manage inventory, and issue invoices automatically. There is a PB fee charged per sale to the buyer of the products or services. The fixed monthly cost to join the simple online store (including for customers participating in the Classic Website or who have their store on only one of PB's marketplaces) will be communicated on the membership platforms. For customers who do not have a classic website and want to integrate their store with other digital environments, there is an additional monthly cost in addition to the PB fee. Automated invoice issuance requires an xZero account (a billing system licensed by AGT) and is mandatory to receive payment for your products or services.

 

Management - Users can create customized websites and online stores to showcase and sell their products or services. Creating a website requires filling out the requested information and accepting the Pacheco Barroso Group's Terms of Use and Privacy Policy. The website and online store will be managed directly by the user through an administrator panel accessible after creating the site. Each user can customize the website, including information about skills, services, projects, awards, contact information, and much more, within the limits allowed by the user panel. The online store will allow for the addition of products/services, order management, and direct communication with customers. The customer will add the desired items to the cart, enter delivery information, and follow the purchase process until completion. For each sale made, a fee may be charged for PB's service. Payment will be managed through methods integrated into the system - see the Payments section above - and the xZero billing system will automatically issue invoices for completed transactions.

 

Local Store (POS / Point of Sale) -They allow freelancers and businesses to list their products or services in a local digital environment, manage inventory, have modules for managing storerooms (for manufacturing industries such as restaurants), and issue automated invoices. There is a monthly fee charged to the merchant. Automated invoice issuance requires an xZero account (an invoicing system licensed by AGT) and is mandatory to receive payment for your products or services.

 

Marketplaces (digital squares) PB -They allow freelancers and companies to list their products or services in an online digital environment on one of our digital marketplaces without having their own website. They also allow freelancers and specialized companies to participate in our standardized stores (PB Portal) and apply for jobs received from clients. Automated invoice issuance requires an xZero plan (an invoicing system licensed by AGT) and is mandatory to receive payment for your products or services.

 

Store and marketplace integration -All our store and marketplace solutions are automatically integrated.

  • Unified stock: Inventory management between the online store, local stores, and the marketplace is unified when necessary or separated (e.g., multiple stores belonging to the same company).

  • Marketplaces: A retailer who has an online store or a local store is automatically connected to our marketplaces and can have sales made in their digital environments or in our marketplaces.

  • Deliveries: Automatic link to our logistics partners (if the product you sell can be delivered).

  • Integrated billing: Invoicing requires an xZero account.

 

Structural modifications- The Classic Website, premium elements, and digital stores have standardized structures. Requesting structural modifications or any other changes is not within the scope of membership. All modification requests will be analyzed as requests for a customized service, and if it is within the scope of work we wish to perform, a proposal with conditions and pro forma information will be addressed and sent to the applicant via an electronic channel (e.g., email).

 

Legal liability- The member is solely responsible for the content, product, services, and legally required licenses listed on the Classic Website to which they have joined and the digital stores in which they are present, and any legal response is the member's responsibility. The member must provide their NIF (Angolan Identity Card number for freelancers or Tax Identification Number for companies) correctly. PB, as a platform, is not responsible for ensuring that the member has the legally required documents, is not responsible for content created by the member, and works with legal authorities when legally required. PB strongly recommends that all members hire a lawyer to draft Terms & Conditions and Privacy Terms for their Classic Website. PB provides a generic version of the Terms & Conditions, Privacy Terms, and Translation Complaint. These elements are provided for convenience only, but PB does not recommend their use without the member obtaining a legal opinion from a recognized and duly certified legal professional in Angola. PB expressly does not authorize the use of its non-generic Terms & Conditions, Privacy Terms and Translation Complaints.

 

Prohibited Content- PB does not permit or tolerate the listing, marketing, or creation of content that leads to scams, the sale of illegal items or substances, or content that violates PB's ethical standards. PB's ethical standards do not permit explicit products, defamatory content, bullying, discrimination, human exploitation, intolerance, misinformation, the promotion of antisocial activities, or activities that endanger lives. PB will do its best to identify anything that violates its ethical standards, but is not responsible for the content created by members. If content is found to be prohibited or contrary to its ethical standards, PB reserves the right to block and/or delete the Classic Website, content, and even ban the member from using any PB product in any forum without explanation or prior warning.

 

 

Services - Logistics of goods and people
(Offered through various brands and partners)

 

Logistics partnerships -PB partners with logistics companies to help transport goods and people from point A to point B. These services are charged at a rate determined by PB to customers and provided by our partners.

 

Merchant-provided logistics -Some merchants may offer delivery services as part of their services and internal capabilities. These merchants can offer their logistics services to their customers at their own rates.

 

xZero
(ERP - Enterprise Resource Management System that includes Billing and Pre-Accounting)

 

Issuance of certified documents -The xZero billing system is certified by AGT and issues the following certified documents: proformas, invoices, bills, receipts, debit notes, credit notes.

 

Data analysis -As part of its design, the xZero system seeks to provide users with tools to manage and analyze the financial development of their economic activity. The system provides a pre-accounting analysis, that is, an analysis that gives the user a preliminary and advisory overview before having the accounting information analyzed by a certified accountant. This pre-accounting analysis is for informational purposes only, and the user must hire an accountant to provide an opinion to ensure the user is complying with their tax and other obligations. The analysis is based on the best efforts of PB and its team, but is not guaranteed to be 100% accurate, as it also depends on the quality of the information provided by the user. There are other xZero modules that can be better understood on the relevant system pages.

 

Plans and information -xZero plans and information are specified on their website.

Limitations of Liability for the Billing and ERP System (xZero) -PB provides the xZero system "as is," with no guarantees of uninterrupted continuity, error-free performance, or compatibility with external systems. PB shall not, under any circumstances, be liable for data loss, service interruptions, incorrect user configurations, or failures in issuing tax documents, except in cases of error directly attributable to PB and confirmed by an independent technical audit.

The user is responsible for ensuring that categories, taxes, legal data, and business rules are correctly configured within the xZero system. Periodic validation with accounting professionals or legal advisors is recommended.

PB does not guarantee or ensure automatic compliance with tax requirements other than those expressly related to the issuance of invoices as required by AGT, legal or regulatory standards applicable to the user's business, and the user is solely responsible for such compliance.

Limitations of Liability on Inventory Management -PB provides tools to support inventory management, based on data entered and configured by the user. The accuracy, completeness, and timeliness of this data are the sole responsibility of the user. PB is not responsible for losses, stockouts, excess orders, product deviations, or any operational or financial consequences resulting from incomplete, incorrect, or outdated information entered into the system.


 

General

 

A PB is not responsible for any problems or technical malfunction of any telephone or computer line and online systems, servers, or providers, computer equipment, software, email failure, technical problems or internet traffic congestion.

 

A PB expressly disclaims any responsibility or liability whatsoever resulting from any content of the study material made available to subscribers.

A PB does not guarantee that all information is reliable, disclaims all liability to any person for any loss or damage caused by errors or omissions, whether such errors or omissions result from neglect, accident or any other cause. The PB is not responsible for the interpretation and/or use of information contained on the website, nor does it offer a guarantee of any kind, express or implied.

 

Some basic notes

  • To protect the privacy of our users, their identities are kept confidential anonymous. In most of the cases, ours partner suppliers receive only an identifier that names their invoice or service

  • A PBdoes not provide support for users who interact outside the platform's usage rules

  • Rude, abusive, inappropriate or violent messages will not be tolerated and may result in a ban warning or user blocking.

  • A PBis open to all. You agree not to discriminate against any memberof our team,user or partner provider based on gender, race, age, religious affiliation, sexual orientation or other parameters and acknowledges that such discrimination may result in their being blocked from the platform

 

Non-Financial Nature of PB -PB is not a financial institution, does not act as a banking entity, credit union, electronic money institution, digital wallet operator, payment institution, nor does it qualify as a Payment System Provider under the legislation in force in Angola, namely the regulations of the National Bank of Angola (BNA).

Any integration with payment methods is carried out through duly licensed third parties, and these providers are solely responsible for regulatory compliance, movement of funds, and provision of financial services. PBdoes not hold, move or store any user fundsat any time.

General Exclusions of Liability -Under no circumstances will PB be liable for indirect, special, incidental, consequential, or punitive damages, including loss of profits, revenue, contracts, data, reputation, or business opportunities, even if advised of the possibility of such damages. Use of the platforms is at the user's sole risk. PB will not be liable for technical failures, temporary unavailability, delays, interruptions, viruses, or any other technical problems that prevent, limit, or compromise the normal operation of its platforms, provided they are not the result of gross negligence or willful misconduct.

Force Majeure -PB shall not be liable for any failure or delay in fulfilling its contractual obligations where such failure or delay is caused by circumstances beyond its reasonable control, including, but not limited to, natural disasters, pandemics, wars, strikes, supplier failures, cyber-attacks, power outages or failures in external telecommunications infrastructure.

A PBallows Users to submit content in different areas of its Websites. By submitting content, the User is declaring that he/she is the sole and exclusive owner of the associated rights and that he/she authorizes thePBto disseminate said content, in the publication it deems most appropriate and for any and all available media. The User will remain the owner of the content thatsubmits to PB, and by sending the content, the User will be granting thePBa free, irrevocable, transferable, non-exclusive and perpetual license to use said content as well as to transmit or license it to third parties, in any support or format currently existing on the market or that may emerge.

The User guarantees that the content submitted to our Websites is not obscene, offensive, or gives rise to civil or criminal liability, and does not violate the intellectual property rights of third parties. The User is solely and exclusively responsible for all content posted on the Websites.PB, namely, the comments you make in forums, the messages you post, or any other content you wish to share. If you wish to actively participate in forums, comment on our articles, or the opinions of our readers, please bear in mind that these spaces are essential for the free expression of opinions and ideas, but mutual respect and courtesy are factors that cannot be overlooked. The User acknowledges thatPB it is not thanksto monitor, edit or preview the content or comments that are shared by Users on their Websites.

However, the editorial offices of the various media outlets owned byPB, reserve the right not to publish on their websites comments that they consider to be, in particular, racist, xenophobic, offensive or defamatory or that, in general, do not intend to contribute to the clarification, debate or discussion of the topics. All comments or content that may be shared by the user on the Websites ofPBconstitute the opinion of their author, which is binding only on him and does not reflect the opinion or position ofPB. The fact that content disseminated by a User or third party has been disseminated on the Websites ofPBdoes not presuppose that he had any prior knowledge of it, much less that he agrees with or supports its content. For all legal purposes, it is presumed that thePBand the editorial staff of the various titles are unaware of the content shared by third parties and Users on the aforementioned Websites.

The User undertakes, in particular, not to use the Websites ofPBfor: (i) commercial purposes, namely, disseminating advertising messages in the comments or in other spaces, outside of those specifically intended for advertising contracted under appropriate terms; (ii) disseminating hateful or discriminatory content or that, in general, encourages violence or the commission of illegal acts; (iii) disseminating content that aims, solely and exclusively, to humiliate, denigrate or harm the good name and reputation of third parties.

 

User Submitted Content -Users are solely responsible for any content (text, images, videos, products, descriptions, etc.) they submit, publish, or make available on PB platforms. By submitting content, the user grants PB anon-exclusive, worldwide, royalty-free, transferable license to use, reproduce, adapt, publish, translate, and display this contentfor operational, promotional, and commercial purposes of the platform. PB reserves the right to remove or disable content that violates applicable laws, third-party rights, or these Terms.

 

PB reserves the right, but not the obligation, to monitor, edit, or remove user-generated content that violates these Terms or applicable law, without prior notice.

 

INTELLECTUAL PROPERTY OF THE CONTENTS OF OUR WEBSITES

All content made available on the Websites is and remains the property ofPB. The User is not authorized to: (i) remove or use any indication of intellectual property, including, but not limited to, trademark or other notices referring to intellectual property from any content of the Websites ofPB; (ii) reproduce, modify, make derivative works,distribute,license, rent, sell, resell, transfer, publicly display or perform, transmit, reproduce, broadcast, or in any other way exploit the contents of the Websites ofPB, except to the extent expressly permitted in writing byPB; (iii) create links or reproduce through "frames" any proprietary content or content made available on the Websites ofPB; (iv) create or launch any programs or scripts to capture, index, collect or otherwise extract content from the Websites ofPB, or unduly overload and/or make impossible the operation and/or functionality of the Websites; or (v) attempt unauthorized access to said content, reserved areas and personal accounts or damage any aspect of the content of the Websites ofPB. PRIVACY OF YOUR DATA

The privacy of your data is essential to us andPBinvests considerable effort and dedication to ensure that its Users' data remains confidential, specifically by implementing security and privacy policies. All information you provide will be used byPB, under the terms and within the limits established in our "Privacy Policy", so we suggest that you read it carefully.

PB undertakes to treat users' personal data in accordance with theLaw No. 22/11 of June 17 – Angolan Personal Data Protection Law, and other applicable standards.

The user authorizes the processing of their personal data for account management purposes, commercial communications (when authorized), service improvement, and compliance with legal obligations. PB may subcontract data processing to duly contracted third parties bound by confidentiality and security clauses.
